Get your Deed of Apartment executed

Dear Members:

As per Section 5 (2)  of the Haryana Apartment Ownership Act (Click here for copy ), it is mandatory for each apartment owner to execute Deed of Apartment to claim ownership of their apartment.  Deed of Apartment is also mandatory from Voting Rights perspective and as per the Public Notice issued by Director Town & Country Planning (attached).
CP2RWA has contacted a Lawyer to facilitate execution of Deed of Apartment for all the Owners of CP2.  The process for getting your Deed of Apartment will be the following:
a. Visit the Lawyers office between 10 a.m to 11 a.m – Mon to Friday. Take the following with you:

i. Copy of Conveyance Deed / Registry

iii. Please take 1 witness along who can sign.

ii. ID Proof of Owner and Co-Owners (if any)

b. Lawyer will prepare draft of Deed of Apartment, then send someone with you to Hall No 1 in Mini Secretariat
c. It will take 1 to 2 hours to get photo and finger print done there. Witness will also be required to go through this process with you.
d. The Deed of Apartment can be collected from Lawyers office 2 days after this.
e. A discounted charge of Rs. 1000 has been fixed by the Lawyer’s office for all owners of CP2, which can be paid at the time of collection of the document.

Directions to Office – From CP2, cross Rajiv Chowk and go towards Mini Secretariat. On the right hand side is Hotel Ramada, 500 Mtrs after crossing that, you see a row of small shops – one of them has “Hunny Document Center” signboard. The office is behind this document center.
Please note that CP2RWA is only posting this to facilitate the process of getting your Deed of Apartment.

    Many owners have called to clarify a few things, so we are posting additional information here:

    Ques: If you have a conveyance deed, do you still need a Deed of Apartment?
    Ans : Yes, Conveyance Deed is not recognised by the Haryana Apartment Ownership Act and Rules. The Act only recognizes the Deed of Apartment as the document that secures your title to the apartment. This is particularly applicable for Apartments in group housing colonies. Even if you have a Conveyance Deed, you must get your Deed of Apartment made.

    Ques: Deed of Apartment can only be made if the builder has filed Deed of Declaration. Is that true?
    Ans : Yes, the Deed of Declaration is filed by builder to define common areas etc. Deed of Apartment defines the owners share of rights in those common ares. Therefore, Deed of Declaration is required to create Deed of Apartment.
    In the case of CP2 owners, Deed of Declaration copy is already available with above-mentioned lawyer so you don’t need it’s copy.

    As I understand, DOD is mandatory for a builder before conveyance of first apartment, to enable prospective owner to file his DOA. With a mere conveyance deed, an illegal instrument of transfer, one’s rights to Common Areas and appurtenant gets already compromised. Any comments?

      You’re right. In the case of Central PArk 2, builder filed DOD for 9 out of 29 towers. In the DOD, items like clubhouse are described but on ground, nothing has been made.
